| dc.description.abstract | У статті йдеться про право людства на мир, забезпечення котрого є основною умовою дотримання прав людини. Звернуто увагу на взаємозалежність між миром та дотриманням прав людини. Розуміння права людства на мир вимагає нових підходів до механізмів його забезпечення, що можуть передбачати також міжнародні миротворчі місії та операції. Запропоновано визнати право людства на мир у міжнародній декларації, котра стане першим кроком до його визнання на міжнародній арені саме як права людства, що призведе до викорінення практики обґрунтування порушення миру необхідністю захисту прав людини. | uk_UA |
| dc.description.abstract | The right of the humankind to peace is an independent right which derives from the third generation human rights. The subject of this right is humanity, because it is impossible to ensure peace for a smaller group of people due to unpredictable consequences that violation can bear to both affected and non-affected territories. The right of humanity to peace requires a broad understanding of the protection mechanisms beyond the "traditional" human rights protection mechanisms. The article also provides analysis of the peacekeeping and peace-building missions which include human rights monitoring components. The interdependency between human rights and peace defines the structure and mandate of the mentioned missions. Recognition of the right of humanity to peace might lead to elimination of the "war for peace". Therefore, it is important to recognize the right of humanity to peace in a soft-law document, which will be the first step to enforceability of this right. | en_US |
