dc.descriptionThere is a need in Ukrainian society to increase the efficiency of participation in state governance in general. This aim can be reached by implementing innovative methods of participation, promotion, and support of e-democracy concept development. The article addresses the necessity of information and communication technologies (ICT) usage regulation for the purpose of the new and real implementation of the right to participate in governance ("participation right"). The author searches the ways to achieve this aim, what needs to be provided to empower state bodies and to legally respond to the results of the usage of various electronic instruments (e-petitions, e-voting, e-budgeting, etc.), and what should be done to expand the list of possible ways for citizens to participate in the era of principally new technologies. In addition it should be stressed that e-democracy is about democracy, so the risk of electronically empowering dictatorship must be avoided. Attention is attracted to the matter of difference between e-democracy and e-governance and how this should be reflected in public policy and state regulation. The author analyzes whether the Ukrainian legislation generally contains necessary legal mechanisms in order to enable the use of ICT in the implementation of the above mentioned "right to participate" and whether there is any need for their improvement, or should they be newly developed and implemented. The European experience on e-democracy implementation, which is accumulated in the Recommendation of the Committee of Ministers of the Council of Europe on e-democracy (2009), correlates with the current Ukrainian legislation on the topic. The author also examines the need and sufficiency of the "technological neutrality" principle implementation in order to enforce and expand the “right to participate” in perspective.en_US
dc.description.abstractСтаттю присвячено проблематиці унормування використання інформаційно-комунікаційних технологій (ІКТ) при реалізації конституційного права громадян на участь в управлінні державними справами ("право на участь"), потреба в підвищенні ефективності реалізації якого нині гостро назріла та може бути досягнута через втілення ідей електронної демократії. Досліджено наявність в українському законодавстві достатніх правових підстав для використання ІКТ при реалізації означеного вище "права на участь". Автор спирається на європейський досвід впровадження е-демократії, аналізуючи положення Рекомендації Комітету Міністрів Ради Європи щодо е-демократії 2009 року, та співвідносить їх із положеннями чинного законодавства України. Також окремо розглянуто питання необхідності та достатності запровадження принципу технологічної нейтральності для реалізації "права на участь".uk_UA
