dc.description.abstractУ статті з’ясовано необхідність ратифікації Конвенції про захист дітей та співробітництво з питань міждержавного усиновлення від 29 травня 1993 р. і досліджено перспективи удосконалення інституту міждержавного усиновлення в Україні. Проаналізовано полеміку та визначено витоки неоднозначного ставлення української спільноти до необхідності ратифікації Гаазької конвенції шляхом розгляду позицій обох сторін дискусії. Зроблено аргументований висновок, що ратифікація Гаазької конвенції 1993 р. сприятиме встановленню уніфікованого та спрощеного порядку співпраці між державами, залученими до процесу міждержавного усиновлення, що дасть змогу Україні впровадити ефективну міжнародно-правову модель контролю за умовами проживання і виховання українських дітей, усиновлених іноземцями.uk_UA
dc.description.abstractThe article addresses the issue of the necessity of ratification by Ukraine of the Hague Convention on the Protection of Children and Cooperation in Respect of Interсountry Adoption of 1993. The accession of Ukraine to this international document has been discussed for a long time by major political actors, public servants, non-governmental organizations, and representatives of civil society. However, the Verkhovna Rada (Parliament) of Ukraine repeatedly has not ratified Convention. The author reviews both sides of the polemic and determines the main controversial issues, such as participation of accredited bodies and approved (non-accredited) persons in the process of intercountry adoption, credibility and effectiveness of monitoring the system of adopted children abroad, the place of bilateral agreements with the countries whose citizens adopt the majority of orphaned children from Ukraine, competition between international and national adoption, as well as competition between organizations that represent different Receiving States. The research leads to the conclusion that the State plays an important role in choosing the model of implementation of the Hague Convention of 1993, because this international document has established minimum standards; however, it is not a universal legal act of adoption. An exclusive competence of Ukraine is the specification of criteria for accreditation and authorization of national and foreign organizations respectively, definition of the number for foreign accredited bodies that may be authorized in Ukraine. Thus, the participants of the discussion should focus on the choice of the model of the intercountry adoption institute instead of continuing the consideration of negative aspects of ratification by Ukraine of the Hague Convention on the Protection of Children and Cooperation in Respect of Intercountry Adoption of 1993.en_US
