dc.descriptionThe article reveals some problems of applying the provisions of certain laws of Ukraine regarding ownership transparency of broadcasters, such as an imperfect terminological apparatus of the Law of Ukraine "On Television and Radio Broadcasting"; discrepancy between its mechanisms and purpose of legal regulation; insufficient resources of regulatory and control bodies in checking the reliability of information on the ownership structure of broadcasters. The legislation on the transparency of media ownership has been designed to introduce additional guarantees of free speech and to create transparent conditions for the licensing of broadcasting as a means to guarantee distribution of objective and unbiased information free of any pressure and censorship. Proceeding from the research, the author concludes that the current legislation of Ukraine on the transparency of media ownership is at the stage of initial formation. Thus, the most difficult practical issue is the application of the Law on affiliates and related persons of the subject of information activities. The above definition in the law does not distinguish between them. Affiliates, in the author’s opinion, should be considered as type-related persons. Such ambiguity in the legislation deviates from the principle of legal certainty. Another problem that has arisen in the practical application of the Law is that the information to be disclosed is classified information about legal entities in which the subject information activities owners and their family members are managers or owners of substantial participation. After all, in terms of goals, disclosure of legal entities operating in other markets, has no meaning. Therefore it is essential in the nearest future to focus on identifying the maximum number of practical problems in their application in order to avoid mechanical transfer of imperfect norms of the Law of Ukraine "On audiovisual services". This is currently being developed to meet the requirements of the Association Agreement between Ukraine and the EU and is to become the main core law in audiovisual services.en_US
