dc.descriptionThis article analyzes the practice of international courts concerning peaceful assemblies which lead to blocking the roads. The study focuses on and summarizes the practice of the European Court of Human Rights and the European Court of Justice concerning the application of proportionality principle to these issues. The author addresses the issue of balancing the right of participants of a peaceful assembly to use a part of public thoroughfare for conducting an assembly and public interest on the unrestricted road use. From the author’s point of view, there are two main approaches to balance the right of people to assemble peacefully and in the public interest on unrestricted road use. According to the first approach, the public interest always prevails, while the second approach provides for balancing the interests of both groups on the basis of the principle of proportionality. The second approach is the one supported by the European Court of Human Rights and the European Court of Justice. Finally the author comes to the conclusion that the European Court of Human Rights always attempts to make the decision in a concrete case, considering certain circumstances. For instance, what the main intention of organizers is, whether the subject of peaceful assembly is the question of urgent public interest, etc. But the general rule is that in usual circumstances, when participants of an assembly are in good faith, the right to freedom of peaceful assembly prevails over temporal discomfort caused by the blocking roads during a peaceful assembly.en_US
dc.description.abstractСтаттю присвячено аналізу практики міжнародних судів щодо мирних зібрань, які призводять до блокування транспортних комунікацій. Розглянуто питання балансування прав учасників зібрання на використання частини публічного простору і суспільного інтересу щодо безперешкодного використання доріг. Досліджено та узагальнено практику Європейського суду з прав людини та Європейського суду справедливості щодо застосовування принципу пропорційності в цих справах. Автор доходить висновку, що за нормальних обставин, коли учасники мирного зібрання діють добросовісно, право на свободу мирних зібрань превалює над тимчасовими незручностями, викликаними блокуванням доріг.uk_UA
