Abstract
Існуючі форма і зміст системи кримінальних покарань показали свою неефективність у
протидії злочинності. Заходи з гуманізації карного впливу не привели до зниження злочинності.
Система обмежень прав і свобод, яка є сутністю покарання, не сприяє поновленню соціальних
зв 'язків засуджених. Необхідно переосмислити можливості кримінально-правового впливу на
поведінку засуджених і змінити форми та спрямованість такого впливу.
Description
The article is focused on the problem of the form and contents of the punishment and its goal. It is
necessary to pay the fundamental attention first of all to the resumption of rights of victims, while the
enforcement through the punishment should be applied to persons, which do not want to bear the
punishment voluntarily. The enforcement is necessary to direct first of all on resumption of the right
through the eliminating of the injury or recovering of the damages.
