Abstract
У статті розкрито питання верховенства права та забезпечення прав людини на тимчасово
окупованих територіях України. Висвітлено нормативно-правові, внутрішньо-організаційні та
процесуально-правові засади та заходи щодо забезпечення прав людини на тимчасово окупованих
територіях України. Звернуто увагу, що суди України стосовно тимчасово окупованих територій
активно використовують практику Міжнародного суду ООН, зокрема його Консультативний висно-
вок від 21 червня 1971 р., у якому сформульовані т. зв. «Намібійські винятки». Документи, видані
окупаційною владою, суди повинні брати до уваги, якщо їх нехтування веде за собою серйозні пору-
шення або обмеження прав громадян.
The article deals with the rule of law and human rights in the temporarily occupied territories of Ukraine. The author highlights the legal, internal organizational, and procedural legal principles and measures to ensure human rights in the temporarily occupied territories of Ukraine. It is noted that courts of Ukraine are actively using relatively to the temporarily occupied territories practice of the International Court of Justice, particularly its Advisory Opinion of 21 June 1971, which formulated the so-called “Namibia exception” – documents issued by the occupation authorities, the courts should be taken into account if they neglect is a serious violation or restriction of human rights. A review of this kind of court documents does not mean automatic recognition of the occupation authorities. “Namibian exceptions”, actively promoted for using by courts of Ukraine, are the appropriate by the Case-Law of the European Court of Human Rights (Loizidou v. Turkey, 18.12.1996, §45, Cyprus v. Turkey, 10.05.2001, §§ 92, 96, Mozer v. the Republic of Moldova and Russia, 23.02.2016, §142). According to Article 17 of the Law of Ukraine of 2006 “On the Enforcement of Judgments and the Application of the CaseLaw of the European Court of Human Rights”, while adjudicating cases, courts shall apply the Convention and the case-law of the Court as a source of law.
