dc.descriptionThe Constitution of Ukraine recognizes the international treaties as part of the national legislation. But their place in the legislation of Ukraine is not clearly defined. Also the principles and priorities in correlation of norms of the international treaties and norms of the national legislation are not clearly defined either. The author proves that only 70 % of existing codes and 20 % of existing laws of Ukraine define the priority of international treaties over the national legislation, and explains possible reasons of such conditions. Priority norms of the international treaties have been researched by methods of context search and content analysis. The context is presented by texts of Ukrainian laws and the search system is rada.gov.ua, an official site of Ukrainian Verkhovna Rada. Content analysis of norms that regulate correlation of the international agreements and the national legislation was accomplished is accordance with the found information array. The vast majority of actual Ukrainian laws lack the priority of international law norms. The reasons for this are as follows: 1) Ukrainian legislation is in the process of its formation in the direction of sticking to the world standard in the legal area; 2) the subject of legal regulation of international agreements is limited by traditional areas of their regulation; 3) priority of Ukrainian law norms in separate areas of legal regulation is explained by a conscious intention of preserving the state’s sovereignty in these areas. The main problems of international agreements legal binding are as follows: an unidentified place of international agreements is the Ukrainian legislation system; inconsequent implementation of the term of international agreements as a part of national legislation; occurrence of a collision between norms of international agreements and Ukrainian laws; an inconsequent legislator’s position regarding the definition of international agreements priority over Ukrainian laws.en_US
dc.description.abstractУ Конституції України міжнародні договори визнано частиною національного законодавства. Але їхнє місце в законодавстві України чітко не визначено. Також не встановлено принципи та пріоритети у співвідношенні норм міжнародних договорів та норм законів України, що призводить до виникнення колізій у процесі їхнього застосування. У статті встановлено, що лише у 70 % чинних кодексів України та у 20 % чинних законів України визначено пріоритет норм міжнародних договорів над нормами національного законодавства та зазначено можливі причини такого співвідношення. Пріоритет норм міжнародних договорів досліджено методами контекстного пошуку та контент-аналізу.uk_UA
