| dc.description | In the scientific article examines theoretical and legal issues of applying disciplinary procedures. The attention on the importance of disciplinary liability as part of providing labor discipline. The influence of modern codification of labor legislation on improving the procedures for applying disciplinary action. Scientific and theoretical approaches of the mentioned issues. The conclusions and suggestions. In terms of Ukraine’s progress towards democratic, social and market reforms, legislative support procedures applying disciplinary must take into account the following principles as the rule of law; definition; openness; transparency; legal certainty; The advantage of less stringent disciplinary action; compliance with disciplinary nature of the offense; availability of appeal procedures employer decisions on disciplinary action. In view of the above, the main trends of improvement of legislative regulation of disciplinary liability are as follows: 1) revision of the draft Labour Code for determining stages of a disciplinary responsibility in accordance with international, including European standards; 2) granting the employer the right to impose disciplinary liability only if the commission of the offense when no respectable circumstances; 3) the right employee the right to appeal to the trade unions and other civil society institutions, the bar on representation of the rights and legitimate interests of disciplinary issues; 4) introduction of mandatory employee to provide copies of the order on the application of disciplinary action; 5) reduction of terms of detection and finding of the commission of the offense from six to three months of the commission; 6) the possibility of expanding the rights of the employer on the application of disciplinary sanctions as: warning, comments; 7) introducing transparent procedures for appealing the decision on the application of the employer to the employee disciplinary measures; 8) introduce a mechanism for immediate withdrawal of disciplinary sanctions, if the employee has established itself on the positive side, has achieved success in work and so on; 9) outlining a comprehensive range of legal consequences for bringing the employee to disciplinary action. | en |

Акцентовано увагу на важливості дисциплінарної відповідальності як складової забезпечення трудової дисципліни. Визначено вплив новітньої кодифікації трудового законодавства з питань удосконалення процедури застосування дисциплінарної відповідальності. Досліджено науково-теоретичні підходи з означених питань.
