dc.descriptionThe necessity of an objective examination of intellectual property rights problems protection has been caused, in terms of constitutional reform, by certain changes in the constitutional-legal doctrine and the form of protecting civil rights, enshrined in Article 55 of the Constitution of Ukraine (the judiciary) in particular. Current problems connected with ensuring protection of commercial designations and the track of dynamics of the changes to the legal doctrine on this issue have been examined in given article. Examples of judicial practice have helped to introduce the material.en_US
dc.description.abstractПотреба об’єктивної необхідності дослідження проблем забезпечення захисту прав на об’єкти права інтелектуальної власності в умовах конституційної реформи зумовлена певними зрушеннями в конституційно-правовій доктрині щодо основної форми захисту цивільних прав, закріпленої у статті 55 Конституції України, – судової. У статті досліджено актуальні проблеми забезпечення захисту прав на комерційні позначення, відстежено динаміку певних змін у правовій доктрині стосовно цього питання. Приклади судової практики допомогли більш наочно представити матеріал.uk_UA
