dc.description.abstractУ статті проаналізовано найбільш спірні аспекти визначення злочину геноциду в між­ народному праві згідно з Конвенцією ООН про запобігання злочинові геноциду і покарання за нього. Розглядаються декілька справ Югославського та Руандійського трибуналів, у яких тлумачиться визначення злочину геноциду. Робиться висновок про те, що за ідентифікацією жертв та наміром знищити цілком або частково національну групу Голодомор 1932-1933 рр. в Україні відповідає визначенню злочину геноциду, а також є геноцидом згідно з міжнародним звичаєвим правом.uk
dc.description.abstractThis article deals with the most disputable aspects of definition of genocide in international law under the UNO Convention on the Prevention and Punishment of the Crime of Genocide. It analyses some cases of the Yugoslav and Rwanda Tribunals in which the crime of genocide is interpreted. The author comes to the conclusion that following the identification of victims and the intent to destroy, in whole or in part, a national group, the Holodomor of 1932-1933 in Ukraine corresponds to the definition of genocide and constitutes genocide under international customary law.en
