dc.description.abstract | The article deals with the definition of European cross-border procedures place within the structure of the civil procedure of the Member States and the relevant provisions requiring harmonization for resolving civil and commercial cross-border cases. In the light of European integration and with the aim to ensure a deep and comprehensive free trade area between Ukraine and the EU, the approximation of national legislation to European standards of protection of rights in cross-border cases is very important. Harmonization of the civil procedure and creation of a Genuine European Area of Justice for consideration and resolution of civil and commercial cases crossing the border of all Member States in the EU were really an evolutionary step that allowed to increase the level of access to justice and ensure the implementation of the main provisions of the EU Treaties. In this article, we want to determine the place of European procedures and relations with the national civil procedure of EU Member States, which will give us the provisions that require harmonization, and especially their use during the consideration and resolution of civil and commercial cross-border cases. Summarizing, it is highlighted that pan-European procedures for resolving civil and commercial crossborder cases are the special proceedings of the unified EU Civil Procedure used as an alternative to national procedures and available in the cross-border case. Particularly it is highlighted that important aspects of civil procedure harmonization in EU Member States national civil procedure are the provisions on cross-border features of the cases. The codified acts and laws of the Member States reflect the position of the features of the application of EU law. Therefore, for their effective civil and commercial trial, it is required that the provisions on the right to apply common European procedures be harmonized; the right to appeal on the decisions adopted in common European procedures is exercised; the transfer into the national civil procedure when it is prescribed by common European procedures is provided. | en_US |
