dc.descriptionThe article provides an overview of some theoretical and practical aspects of the jurisdiction of the ICC with respect to the situations in Georgia and Ukraine. The research is based on the comparative legal analysis of the situations in the two states. Such an approach was dictated by the similar background of the armed conflicts, regional particularities and political actors involved therein. The first part of the article is dedicated to the evaluation of the recent developments in proceedings of the ICC in the respective situations. In addition, the author analyzed miscalculations of Georgia and tactics of the Russian Federation in relations with the ICC. Some important observations are made concerning the unwillingness of the Georgian government and investigative authorities to investigate the crimes involving Georgian military forces, and the implications of such inaction for the advancement of the proceedings before the ICC. The second part of the article provides a detailed examination of different aspects of the subject matter, temporal, territorial and personal jurisdiction of the ICC in the aforementioned situations. A special attention is given to the assessment of the competence of the ICC to hear the cases when one of the sides of an armed conflict is non-party to the Rome Statute. Moreover, controversial jurisdictional issues may arise when a non-party state lodges a declaration under the article 12(3) of the Rome Statute accepting the Court jurisdiction. On the basis of this analysis, the article concludes with recommendations concerning the further cooperation of the government of Ukraine with the ICC.en

Оцінено поточний стан розгляду цих ситуацій, проаналізовано прорахунки грузинської сторони і тактику Російської Федерації у відносинах з Міжнародним кримінальним судом. Досліджено наявність окремих аспектів юрисдикції Суду в згаданих ситуаціях. Надано рекомендації щодо шляхів подальшої співпраці України та Міжнародного кримінального суду.uk
