dc.descriptionThe research paper examines one of the aspects of interdisciplinary (with international criminal law) and interscientific (with the science of philology) connections of domestic criminal law. The authors emphasize the incorrect perception of certain terms from legal acts by philologists and lawyers without referring to the legal essence of those terms. During the realization of the official translations of international treaties (conventions, pacts, etc.), it is obligatory to involve lawyers who specialize in the relevant areas of law. The language of law is extremely specific; it contains contexts and nuances that are difficult to handle for professional translators with only philological training. the fundamental provisions of the domestic theory of criminal law. The idea about the need to shift the emphasis from subjective aspects to the existence of a causal relationship between the attack – as a component of a war crime – and the consequences are caused on "civilian victims" (this term was proposed by the authors for use in law) is put forward. It is argued that an indication of the accidental nature of the harm caused may hinder the prosecution of perpetrators for war crimes. The position according to which national criminal law should be internally harmonious and concise is upheld. When legislatively formulating certain norms, it is important to avoid redundant detailing, which may create additional risks during enforcement. In the tendency to legal certainty, it is important not to be engrossed with the idea of maximally filling the text of the criminal legislation, rejecting time-tested methods of its rational presentation using criminal law norms with blanket disposition.en_US
dc.description.abstractУ статті розглянуто один з аспектів міжгалузевих (з міжнародним кримінальним правом) і міжнаукових (з наукою філологією) зв’язків вітчизняного кримінального права. Автори акцентують на некоректності сприйняття певних термінів з юридичних актів філологами і юристами без звернення до їх правової сутності. Пропонується інший переклад відповідних норм, який узгоджується з принциповими положеннями вітчизняної теорії кримінального права. Висунуто ідею про необхідність перенесення акценту з суб’єктивних моментів на існування причинного зв’язку між нападом – як складовою воєнного злочину – і наслідками, що завдані "цивільним потерпілим" (цей термін авторами запропоновано до вжитку у правознавстві). Стверджується, що вказівка на випадковий характер заподіяння шкоди може стати на заваді притягнення винуватих до кримінальної відповідальності за воєнні злочини. Обстоюється позиція більш лаконічного законодавчого формулювання певних норм з уникненням зайвої деталізації, яка може створити додаткові ризики під час правозастосування.uk_UA
