dc.description.abstractThe article analyzes the constitutional regulation of the correspondence between international and domestic public law in Europe, while concentrating on the domination of European law and the principles of its priority. In constitutions of particular states there are provisions that establish the direct power of the generally recognized principles and norms of international law (or one of these components); specify certain spheres where they act; require mandatory ratification as a condition for enactment of international agreements or provide a list of agreements for the ratification; decide whether there is a priority of international law over national; delegate the sovereignty in the legislative activities to international or interstate bodies. In most countries, the supremacy of the Constitution over international agreements is recognized by establishing the requirement for the ratification of international agreement only in cases of its compliance with the Constitution, or signing the agreement only when the relevant amendment to the Basic Law is made. The exception is the Netherlands, where the Constitution allows the Parliament to approve any provision of an international treaty, even if it contradicts the Basic Law, by the qualified majority of two-thirds (Article 91). There is a controversy regarding the correlation between international agreement and national legislation in Ukraine. The article provides arguments in favor of the position for the priority of international agreements over domestic regulations. If in the statutes of international or intergovernmental organizations or in the international agreement certain principles are acknowledged, and if these principles are recognized by the Constitution as the basic principles of the state, then it may be concluded that the decisions of such international or intergovernmental organizations or the international agreement have a priority over state laws and bylaws.en
