dc.descriptionThe author analyses the problem of an attitude to legal values according to the communitarian approach in philosophy and the theory of law. The topicality of this issue is caused by the fact that nowadays there is no unified position on values of law, their nature, hierarchy, relationship boundaries. Problems are extremely important at the present time, as Ukraine is experiencing a period of gradual transition from one type of ideological and scientific principles to others, so it is needed to explore the background theoretical and philosophical categories, one of which is the legal value, in order to understand the law, its creation and implementation in society. Since its emergence as a philosophical and legal stream, social and political ideology in the communitarianism of the 1980s occupied an important place in scientific discourse. Criticism of liberalism that formed the basis of the communitarian position is still relevant to the Western” (European and American) social, political, and legal philosophy. We can say that opposition between liberals and communitarians is a key scientific debate in the 21st century. Surging world globalization processes affect the development of legal relations between individuals, nationalities, and nations and necessitate a reflection of the current legal phenomena and an adequate prediction of future processes. The liberal conception of man as a free and rationally acting individual is opposed to the idea of not only the person’s social and cultural stipulation but also human activities, values, rights, duties, etc. Communitarians consider a social community as an essential condition for realization of social freedom and justice. Such legal values as justice, common good, utility, freedom get new features in reflecting the philosophy and the theory of law due to developments of communitarian representatives. This elaboration expands the boundaries of legal knowledge and creates conditions for a deeper understanding of the role of law in social relations.en_US
dc.description.abstractУ статті здійснено аналіз проблем ставлення до правових цінностей згідно з комунітаристським підходом у філософії та теорії права. Актуальність цієї теми зумовлена тим, що в правовій науці на сьогодні не вироблено єдиної позиції стосовно цінностей права, їх природи, ієрархії, співвідношення меж. Проблеми є надзвичайно важливими нині, оскільки Україна переживає період поступового переходу від одних ідеологічних та наукових засад до інших, тому потрібно досліджувати вихідні теоретико-філософські категорії, однією з яких є правові цінності, для розуміння права, його творення та реалізації в житті суспільства. uk_UA
