Abstract
У статті аналізуються основні вимоги, які нині є спільними для правової держави –
«Rechtsstaat» і верховенство права – «Rule of law», незважаючи на особливості становлення і розвитку відповідних концепцій.
Description
This article is focused on the fundamental requirements, which are now common for the Rechtsstaat and the Rule of Law regardless the particularities of the coming into being and development of these conceptions. Special attention is paid to the rights and freedoms of an individual as a primary legal source, to the principles of the separation of power, limitation of discretion, the supremacy of the Constitution, legal certainty, proportionality, legal security and protection of confidence, independence of court etc. The theoretical analysis of these principles is combined with the analysis of foreign and national practice of their implementation.
