Abstract
Актуалізовано проблему принципів звільнення від покарання в українському кримінальному праві. Сформульовані поняття та система принципів звільнення від покарання (верховенство права, законність, гуманізм, справедливість, індивідуалізація звільнення від покарання, обґрунтованість та вмотивованість звільнення від покарання в судовому рішенні; урахування інтересів потерпілого від злочину під час звільнення від покарання, невідворотність покарання у разі порушення умов звільнення від покарання). Показано конкретні прояви принципів звільнення від покарання в кримінальному законодавстві та особливості їх дотримання в судовій практиці.
Description
The article is staticized a problem of the principles of release from punishment. It is formulated a concept and the system of the principles of release from punishment (the rule of law, legality, humanity, justice, individualization of release from punishment, validity of release from punishment and its obligatory motivation in the judgment; accounting of interests of the victim from crime at release from punishment; inevitability of punishment in case of violation of conditions of release of companies of punishment). On the basis of the conducted research concrete manifestations of the principles of release from punishment are shown to feature of their observance in the criminal legislation that in jurisprudence.
