Abstract

У статті досліджені теоретико-прикладні проблеми врахування особи винного під час вирішення питання про можливість виправлення засудженого без відбування покарання. На підставі вивчення спеціальної літератури зроблено висновок про те, що проблеми врахування особи винного досліджені недостатньо. У результаті проведеного дослідження встановлені обставини, які характеризують особу винного, що враховуються судами України при застосуванні ст. 75 КК України.

Description

The article investigates separate theoretical and applied problems of accounting of the identity of the guilty person at the solution of a question of a possibility of correction of the convict without serving sentence. On the basis of studying of special literature the conclusion is drawn that problems of accounting of the identity of the guilty person are investigated insufficiently. As a result of the conducted research circumstances which characterize of the identity of the guilty person are established, and are considered by courts of Ukraine at applicationof Art. 75 of Criminal Code of Ukraine.
