Abstract
У статті схарактеризовано аспекти мовної політики України, зокрема нормативне регулювання функціонування мов з різними правовими статусами: мов національних меншин, мов етнічних меншин, мов корінних народів. Досліджено потрактування понять національна меншина та етнічна меншина у наукових працях з філософії
та історії. Проаналізовано законодавство у сфері захисту мовної самобутності представників національних та етнічних меншин попередніх періодів існування Української держави з погляду врахування його положень у мовній політиці України, що визначає використання мов корінних та некорінних народів. Автор стверджує, що
мовне законодавство має забезпечувати інтеграцію представників національних та етнічних меншин до життя суспільства, натомість саме такого підходу бракує Україні, що призводить до політичних маніпуляцій, особливо на Сході держави, Буковині та в Закарпатському регіоні. Чітке розмежування законодавцями мов етнічних і національних меншин, недвозначне формулювання поняття "регіональної мови" є запорукою гармонійного співіснування представників різних національних та етнічних спільнот.
Визначено вплив Законів України Про забезпечення функціонування української мови як державної і Про корінні народи України на мовну ситуацію в державі, а також проаналізовано специфіку формулювання ключових положень цих нормативних актів. Досліджено законодавство періоду Української революції 1917–1920 рр. та можливості урахування його у процесі законотворення в галузі мовної політики сучасною Україною. Обґрунтовано, що врахування попереднього досвіду під час формування засад мовної політики в галузі захисту прав етнічних та національних меншин сприятиме створенню демократичних засад функціонування української мови як державної, консолідації українського суспільства, гармонійному співіснуванню мов в Україні.

This article examines language policy aspects in Ukraine, including regulatory control of language functioning in relation to the legal status: the languages of national minorities, the languages of ethnic minorities, and the languages of indigenous peoples. The author studied the interpretation of the concepts of national minority and ethnic minority in scientific works on philosophy and history. The author analyzes laws protecting language originality of persons belonging to the national and ethnic minorities in previous periods of the Ukrainian state's existence in terms of governing Ukrainian language law provisions regulating the functioning of indigenous and non-indigenous languages. Based on concrete evidence, the author shows that the language legislation aiming to integrate persons belonging to national and ethnic minorities into the society’s life, can be applied to eliminate manipulations in politics in Ukraine, especially in Eastern Ukraine, Bukovyna, and the Zakarpattia Oblast (Transcarpathian region). A clear distinction between languages of persons belonging to national and ethnic minorities legislators and unambiguous formulation of a regional language concept is a key to the harmonic coexistence of persons belonging to national and ethnic minorities. The author defines the impact of the Laws of Ukraine On the provision of the functioning of the Ukrainian language as an official language and On the indigenous peoples of Ukraine on the language situation in Ukraine and analyzes the specifics of key provision formulation of the regulatory documents. The author researched the legislation of the period of the Ukrainian Revolution of 1917–1920 and the possibilities of taking it into account in the process of law-making in the field of language policy in modern Ukraine. The analysis shows that factoring previous experience into the language policy basis with regard to the protection of national and ethnic minorities’ rights allows for supporting the formation of democratic bases of the Ukrainian language functioning as the official language, consolidation of the Ukrainian society, and harmonic coexistence of languages in Ukraine.
