dc.description.abstractУ статті аналізується соціальна обумовленість становлення цивільноправової політики. Обґрунтована необхідність виокремлення таких основних факторів соціальної обумовленості становлення досліджуваного явища, як: аксіологічні, історичні, соціально-економічні, правові, політичні, доктринальні (у сфері правознавства), правозастосовні, соціологічні. У статті аналізуються власне соціологічні фактори. Наголошено, що осмисленню та обґрунтуванню досліджуваного явища сприятиме їх детальна характеристика. Це бачення реалізовано через відповідне соціологічне дослідження, здійснене автором упродовж 2017-2019 рр.uk_UA
dc.description.abstractPaper analyzes the issue of social conditionality of civil policy, which is suggested to understand the need to substantiate objective circumstances: a) the relevant doctrine concerning the past, present or future; b) an independent direction of state activity as a type of legal policy (current and future) in the field of legislative regulation of civil law relations, as well as the practice of civil law. Regarding the doctrinal aspect of the problem, it is noted that it is primarily about scientific knowledge and theoretical development of the direction of the state in the civil law sphere. The purpose of such a doctrine is to recognize the creation of optimal civil law and its effective application in legal practice. It is determined that the scientific formation of civil law policy is necessary, in particular, for: simultaneous consideration of public and private interests, guaranteeing their balance; ensuring legal protection and protection of private interests; ensuring abuse by the state in private relations. Methodological research in this area should focus on the organic combination and relationship of private and public interests, which balance should be a priority in regulating the relationship between the state and the individual. The second aspect of civil law policy concerns the optimal activities, especially of the state and its other actors, to form and implement this type of legal policy (through government analysis, tactics, strategy, management, and monitoring the implementation of relevant decisions in civil relations). Civil law policy as a type of state activity should be based on the developed doctrinal provisions, which are embodied in the relevant concepts, programs, regulations and law enforcement acts. The problem of social conditionality of the formation of civil law policy is revealed through the study of relevant factors. Under such factors it is suggested to understand the system of certain conditions, factors, circumstances, events, facts and so on, which is the driving force of the formation and development of civil law policy. According to the author, the following main factors of social conditionality of the formation of civil policy should be identified: axiological, historical, socio-economic, legal, political, doctrinal (in the field of law), law enforcement, sociological ones. Research article considers the actual sociological factors. It is emphasized that their detailed description will contribute to the understanding and substantiation of the studied phenomenon. This vision was realized through a relevant sociological study conducted by the author during 2017-2019.en
