Abstract
Автореферат дисертації на здобуття наукового ступеня кандидата юридичних наук за спеціальністю 12.00.11 "Міжнародне право". – Львівський національний університет імені Івана Франка, Львів, 2018. Дисертацію присвячено дослідженню правового статусу Прокурора Міжнародного кримінального суду в доктрині та практиці Міжнародного кримінального суду, зокрема, проаналізовано організаційну структуру Офісу Прокурора, визначено його місце серед основних органів Міжнародного кримінального суду, генезис інституту Прокурора у міжнародних кримінальних судах, гарантії його незалежності, а також проаналізовано повноваження Прокурора на кожній стадії провадження справи у Міжнародному кримінальному суді.
У дослідженні особливу увагу приділено процесуальному статусу Прокурора Міжнародного кримінального суду, зокрема окремо розглянуто повноваження Прокурора на стадії порушення розслідування, розслідування кримінальної справи, попереднього кримінального провадження, судового розгляду, апеляційного провадження, виконання вироку та ревізійного провадження.
The thesis abstract for obtaining the degree of Candidate of Legal Sciences in specialty 12.00.11 "International Law". – Ivan Franko National University of Lviv, Lviv, 2018. The dissertation is devoted to the study of the legal status of the Prosecutor of the International Criminal Court in the doctrine and practice of the International Criminal Court, in particular, analyzes the organizational structure of the Office of the Prosecutor, determines its place among the main bodies of the International Criminal Court, the genesis of the institute of the prosecutor in international criminal courts, guarantees of his independence, and also analyzes the powers of the prosecutor at each stage of the proceedings in the International Criminal Court. It is defined that the Rome Statute, the Rules of Procedure and Evidence, the Regulation and other documents of the International Criminal Court under the «prosecutor» understand, on the one hand, an official – the Prosecutor of the International Criminal Court, who heads the Office of the Prosecutor and is responsible for the management of the Office, is elected and is removed from office within the framework of a special procedure, possesses privileges and immunities, approximated by their volume to the privileges and immunities of diplomatic agents. On the other hand, the «prosecutor» understands the entire apparatus – the Office of the Prosecutor, which is assigned three groups of tasks: the receipt and study of any information on crimes within the jurisdiction of the International Criminal Court, investigation and prosecution. The organizational structure of the Office of the Prosecutor is analyzed. It was stated that the Office of the Prosecutor of the International Criminal Court, headed by the Prosecutor, is the organ of the International Criminal Court, which has the following organizational structure: Executive Committee, Divisions (Jurisdiction, Complementarity and Cooperation Division; Investigation Division and Prosecution Division), sections (Services Section and Section of Legal advisers) and the Support Sections and Gender and Children Unit . Their functions are investigated in detail. The guarantees of independence of the Prosecutor of the International Criminal Court have been examined separately. All guarantees of independence of the Prosecutor are divided into three groups: 1) the special order of his election; 2)particularities of removal from office and disqualification of the Prosecutor; 3) the privileges and immunities of the Prosecutor. Particular attentions are paid to the procedural status of the Prosecutor of the International Criminal Court, in particular, the powers of the Prosecutor are separately examined at the stage of initiation of an investigation, investigation of a criminal case, preliminary criminal proceedings, trial, appeal proceedings, execution of sentence and revision.
