dc.descriptionThe article contains analysis of legal basis for determining the quality of linguistic formulation of regulations, and description of weak points and perspectives of implementation of linguistic due diligence of the draft bills in Ukraine. It has been found, in particular, that applicable Rules for Formulation of Draft Bills and Main Legislative Technique Requirements (Guidelines) used by the Management Office of the Verkhovna Rada of Ukraine cannot serve as a basis for effective linguistic due diligence of the draft bills, since the above Rules do not include specific regulations in regards to terminological, lexico-semantic, and logical and syntactic review of legal substyle texts of official style of the modern Ukrainian literary language. In this article methods of linguistic expertise of regulatory documents suggested by Ukrainian experts have been studied, which methods can be applied in terminological, lexico-semantic, and logical and syntactic elaboration of the draft bill texts. The article also outlines the important role of the Ukrainian Commission for Legal terminology in evolvement of national examination activities: the Commission experts have performed a thorough terminological and linguistic evaluation of the draft of the applicable Constitution of Ukraine and a number of regulations. The author emphasizes the need to establish such organizational unit as a part of the Management Office of the Verkhovna Rada of Ukraine. The analysis of logical and syntactic mistakes the legislator made in Article 120-1 of the Tax Code of Ukraine of previous wording, and of specification of the definition of the term suggested in Article 140 of the current version of the Constitution of Ukraine proposed in this article is indicative of the efficiency not only of the methods of the terminological and lexico-semantic elaboration of the draft bill texts, but also the need in analysis of their logical and syntactic nature, and for this reason points to efficiency of the methods of semantic and textual evaluation applied for the legal substyle texts of official style.
dc.description.abstractУ статті проаналізовано правові засади визначення якості мовного оформлення нормативно-правових актів, окреслено їх недоліки та перспективи запровадження в Україні комплексної юридико- лінгвістичної експертизи законопроєктів. Зокрема, встановлено, що чинні Правила оформлення проєктів законів та основні вимоги законодавчої техніки (Методичні рекомендації), якими послуговується Апарат Верховної Ради України, не можуть забезпечити ефективної юридико-лінгвістичної експертизи проєктів законів, оскільки не містять чітких регламентацій щодо термінологічної, лексико-семантичної, логіко-синтаксичної перевірки текстів законодавчого підстилю офіційно-ділового стилю сучасної української літературної мови. Досліджено методики лінгвістичної експертизи нормативних актів, запропоновані українськими фахівцями, які можуть бути враховані в практиці термінологічного, лексико-семантичного й логіко-синтаксичного опрацювання текстів законопроєктів. Зокрема, визначено важливу роль у становленні вітчизняної експертної діяльності Української комісії з питань правничої термінології, фахівці якої здійснили ретельну термінологічно-мовну експертизу проєкту чинної Конституції України та низки нормативно-правових актів, зауважено на потребі у формуванні аналогічного підрозділу в складі Апарату Верховної Ради України. Запропонований у статті аналіз логіко-синтаксичних помилок, яких законодавець допустився в статті 120-1 Податкового кодексу України попередньої редакції, а також уточнення дефініції терміна, запропонованого в статті 140 чинної редакції Конституції України, засвідчує не лише ефективність методик термінологічного й лексико-семантичного опрацювання текстів законів, а й потребу в аналізі їх логіко-синтаксичних особливостей, засвідчуючи дієвість застосування методик семантико-текстуальної експертизи до текстів законодавчого підстилю офіційно-ділового стилю.
