Abstract
У статті досліджено проблемні питання, що виникають у зв’язку з патентуванням винаходів, створених з використанням штучного інтелекту (ШІ), доктрину, відомчу і судову практику у цій сфері в різних юрисдикціях (Австралія, Нова Зеландія, Німеччина). Проаналізовано результати Проєкту "Штучний винахідник". Показано, що заявки DABUS, подані творцем та власником системи ШІ DABUS д-р. Стівеном Талером в 17 юрисдикціях, у більшості були відхилені на рівні відомств інтелектуальної власності (ІВ) та за результатами оскаржень в судовому порядку. У цілому заявнику не вдалося переконати суди та відомства ІВ своєю аргументацією, попри відмінності національного законодавства та патентних систем. Наголошено на важливості вдосконалення законодавства та розвитку системи ІВ у взаємодії з ШІ-технологіями, а також підтримки й заохочення винахідників.
Description
The paper examines the issues arising from the patenting of inventions based on artificial intelligence (AI), doctrine, departmental and case law in this field in different jurisdictions (Australia, New Zealand, Germany). The filing of patent applications in 2018, indicating the AI system called DABUS as the inventor, has sparked an international debate on the concept of authorship of an invention under patent law. The results of the Artificial Inventor Project are analyzed. It is shown that DABUS applications submitted by the creator and owner of the DABUS AI system, Dr. Stephen Thaler in 17 jurisdictions, most were rejected at the level of intellectual property offices (IP) and as a result of appeals in court. In general, the applicant failed to persuade the IP courts and agencies with his arguments, despite differences in national law and patent systems. The decision of Germany may answer the question of the invention of AI. The Federal Patent Court of Germany overturned a decision by the country’s Patent and Trademark Office (DPMA), which rejected a patent application in which AI was named the inventor. After a hearing in November 2021, the court declared that the revised designation of the inventor with the words “Stephen L. Thaler, Ph.D., who prompted DABUS artificial intelligence to create an invention” is permissible. The court stated that adding information about DABUS to the designation of the inventor does not contradict the patent instructions. However, the court stated that DABUS could not be appointed as an inventor; not to appoint an inventor at all; and add “c / o Stephen L. Thaler, PhD” to the designation of the inventor and change the description to say that the invention was created by AI called DABUS. The importance of improving the legislation and developing the IP system in cooperation with AI technologies, as well as supporting and encouraging inventors was emphasized. Governing bodies need to act promptly to keep up with AI-related events and to determine the direction of its development in a timely manner. Policy adjustments are needed to maximize the potential of AI, with a focus on relevant strategies, legislation that takes into account legal and ethical considerations, access to digital data and the impact on the IP system, human resources and investment strategy.
