Abstract
The general purpose of the present analysis is threefold: (I) to identify the doctrinal and structural deficiencies of the existing legal framework in addressing prolonged occupation that has acquired the characteristics of de facto annexation; (II) to articulate a theoretical framework for the legal qualification of such situations and (III) to examine the legal consequences that flow from such qualification, particularly the obligations of non-recognition, non-assistance and cooperation incumbent upon third states.
