dc.description The article presents legal analysis of approaches to understanding of the limits of discretionary powers by public administration bodies. Nowadays, it is generally accepted that the understanding of the limitation of discretion of public administration bodies is the logical prerequisite of effective governance. However, recent challenges for public authorities, which require new and innovative approaches of response, logically result in the gradual expansion of the public authorities’ competence, as well as a wider range of situations where the use of discretionary powers is admissible. The article contains general characteristics of administrative discretion which is based upon the necessity of public administration bodies to be able to effectively and properly apply the law in every situation. Herewith, the article focuses on the importance of establishing the limits of applying the discretion by public authorities. The European Court of Human Rights’ practice has developed an understanding of general admissible limits of human rights by public authorities, for example, through determination and interpretation of the principle of legality. According to the Court’s understanding, the principle of legality should also mean that the decisions made by public authorities are based on legal grounds, and their content corresponds to the essence of legislation. Although the presence of a certain degree of discretion is admissible and appropriate, the limit of such discretion should be minimally sufficient, including prevention of legal regulation violation. That is why the article provides the analysis of several approaches to determining the general limits of administrative discretion, including anti-corruption factors. Thus the main conclusion which is made in the article is that the legal tools of limiting the administrative discretion should be based on the requirements of the rule of law, including the key principle of respect for human rights and freedoms. en
