dc.descriptionThe article analyzes the Conception of the reforms of public offence legislation in Ukraine, developed by the specialists of Lviv forum of criminal justice. The author considers doctrinal and practical issues in the development of the idea of the Ukrainian Public Offence Code as a single statute on the responsibility for crimes, administrative delicts, and disciplinary offences. The author proposes a different approach to the reforms of Ukrainian criminal statute, namely in inserting "criminal delict" and "criminal offence" categories. It is specifically argued that crimes and non-managerial administrative offences have the same legal nature and should jointly be addressed as "criminal offence". The article offers an algorithm of the implementation of "criminal offence" category into the Ukrainian legislation basic elements of the algorithm being: 1. Exclude the norms addressing the specifics of criminal offences’ responsibility from the Code of Criminal Procedure; 2. Address the responsibility for criminal delicts in a separate code consisting of material and procedural parts; 3. Criminal delicts should include only the acts which by their social danger, as well as the severity of the appropriate sanction, would permit applying an out-of-court procedure with a compulsive possibility to appeal the executive decision to the court which would apply all human and citizens’ rights and liberties. This approach is the only way for the criminal delicts category not to become an "extra” degree in Criminal Code, and its implementation would be rational and would bear a specific function. 4. Identify the responsibility in the Criminal Code applicable only to crimes. Develop the categorization of these crimes, and apply this widened approach in order to seriously limit judicial discretion. 5. Establish a simplified and (or) specific procedure for the least dangerous crime categories in the Code of Criminal Procedure.en_US
dc.description.abstractУ статті проаналізовано Концепцію реформування законодавства про публічні правопорушення в Україні, розроблену фахівцями Львівського форуму кримінальної юстиції. Визначено доктринальні та практичні проблеми реалізації ідеї створення Кодексу публічних правопорушень України, що об’єднав би норми про відповідальність за злочини, адміністративні делікти і дисциплінарні правопорушення. Обґрунтовано, що злочини та неуправлінські адміністративні правопорушення мають однакову правову природу, а тому їх доцільно об’єднати поняттям "кримінальне правопорушення". Запропоновано алгоритм запровадження категорії "кримінальний проступок" до українського законодавства.uk_UA
