dc.descriptionThe article contains analysis of normative regulation of legal guarantees of right to work realization during modification of employment contract. The author gives attributes and characteristics of transfers and shifts an employee, as well as changes to essence of labor contract. According to performed analysis results the authors considers the main legal safeguards during exercising employment contract as well as revising some of its terms as follows, - definition of labor function in employment relations; prohibition of demanding from an employee to perform work which is not covered by employment contract; avoiding transfers of workers without their consent acceptance; timely notifying of workers regarding following changes of essential conditions of work. The legal guarantees at shifting employee are quite low and they need to be improved. In order of legal safeguards for realization right to work by a person strengthening it is needed to provide normative obligation of working place written definition at employment contract. This will facilitate to avoid overuse by employers their right to shift an employee, unless otherwise is needed according to labor function specifics. The normative providing of obligatory written three-part agreement for transfer of an employee will became an important guarantee of realization right to work by a person.en
