dc.descriptionThe article deals with the interrelations between international humanitarian law and international human rights law. The nature of the interpenetration of these branches of law is complex. It is noted that the impact of international human rights law on international humanitarian law can be defined as contextual, i.e. one that forms the context of the latter. It is stated that such contextual impact of international human rights law on international humanitarian law became visible only in the twentieth century, especially in its second part. This may be explained by the fact that international human rights law appeared as such only in the middle of the 20th century. Traditionally, the doctrine discusses four models of the norms correlation of international humanitarian and international human rights law. They are as follow: fragmentation, conflict, parallelism, and convergence. These four models do not cover all the aspects of the interaction between the two mentioned above branches of international law. The notion of context and contextuality supplement the search for the models of such interplay. Contextual influence of international human rights law on the international humanitarian law may be traced, for instance, in the humanization of the latter. Humanization may be named an axiological aspect of contextuality. It is supposed that in line with axiological aspect the normative aspect also exists.en_US

Вказано на складний характер взаємопроникнення цих галузей одна в одну. Відзначено, що вплив міжнародного права прав людини на міжнародне гуманітарне право можна визначити як контекстуальний, тобто такий, що формує контекст останнього. Констатовано, що про такий, контекстуальний, вплив міжнародного права прав людини на міжнародне гуманітарне право стало можливо говорити лише у ХХ столітті, особливо в другій його половині.uk_UA
