Визначеність законодавчих дефініцій як умова ефективного дотримання духу та букви закону

Abstract

У статті аналізуються загальнотеоретичні, філософсько-правові та юридико-методологічні аспекти питання визначеності законодавчої дефініції та її ролі у процесі виявлення та дотримання духу та букви закону. На основі аналізу підходів, сформованих західною юридичною наукою, досліджується значення законодавчих дефініцій у контексті ефективності втілення наміру законодавця в законодавчому тексті, а також реалізації принципів правової визначеності, «гнучкості» права та досягнення балансу між ними.

In this article the certainty of legislative definitions and its role in the identification of and adherence to the spirit and letter of law are discussed from the point of view of General Legal Theory, Legal Philosophy and Methodology. Analyzing the approaches formulated by Western legal scholarship, the author investigates the significance of legislative definitions in the context of effective embodiment of legislator's intent in a legislative text, as well as in the context of implementation of the principles of legal certainty and flexibility of law and the attaining of the balance between them.
