Класифікація правових цінностей та її значення для правової теорії і практики

Abstract

У статті проаналізовано проблеми класифікації правових цінностей у філософії та теорії пра- ва. Актуальність цієї теми зумовлено тим, що у правовій науці на сьогодні не вироблено єдиної по- зиції щодо цінностей права, їхньої природи, ієрархії, співвідношення меж. Проблеми є надзвичайно важливими в теперішній час, оскільки Україна переживає період поступового переходу від одних ідеологічних та наукових засад до інших, тому необхідно досліджувати вихідні теоретико-філо- софські категорії, однією з яких є правові цінності, для розуміння права, його творення та реаліза- ції в житті суспільства.

The author analyses the problem of the attitude to classification of the legal values in philosophy and theory of law. The topicality of this issue is caused by the fact that today there is no unified position on values of law, their nature, classification, hierarchy, relationship boundaries. Problems are extremely important at the present time, as Ukraine is experiencing a period of gradual transition to new ideological and scientific principles, so it is needed to explore the background theoretical and philosophical categories, one of which is the legal value, in order to understand the law, its creation, and implementation in society. Understanding the nature of the egal values is carried out within several alternative axiological approaches, most of which seem a reasonable objectivist and subjectivist concept. Undoubtedly, the law is considered impossible to explore out of values. We receive the legal values and evaluations from the sphere of the legal conscience that have a regulatory significance for public relations. Typical is the division of all values in law into two main groups: the values of law for which the law is a tool or a means of implementation, and the actual legal values which can be considered the values with the legal quality. The study of classification of the legal values is important for establishing the law and the legal relationship between different values in each individual case and practical situations. Under the classification we understand a branched logical division of some concept. A scientific classification captures the relationships between classes of objects to determine where a particular object, such as legal values, belongs to the system. But there is no clear opinion on the possibility, in principle, and the need, in particular, to classify legal values. Some scientists believe that all human values are absolute, expressed one after another, which does not allow to compare and correlate them.
