dc.description.abstract The article characterizes the most widely-used models of argumentation within court processes in public law. In particular, it analyzes lawsuits relevant to the reform of the judiciary system in Ukraine. Generally, there is a difference between judicial argumentation in public law and private law. Specifically, this distinguishing feature concerns participants of legal relations in public law. Judicial argumentation in public law always envisages the presence of the representatives of authority that provide argumentation according to the authority. Moreover, judicial argumentation in public law is expressed in the jurisdictional form of defence. By contrast, in private law, a non-jurisdictional form of defence (self-defence) is allowable. Mainly, judicial argumentation in public law relates to the constitutional and administrative lawsuits. Constitutional lawsuit provides the usage of inductive argumentation. Such methodology of argumentation relates to the fact that concrete cases make influence on the system of law. At the same time, administrative lawsuit concentrate on the usage of deductive argumentation. Deductive argumentation is the main methodology for usage due to the peculiarities of legislation of the administrative procedure. Furthermore, an important fact is a considerable amount of administrative cases in courts. In this context, we can observe the direct transfer of certain legal norms to concrete judgments in particular cases. Judicial argumentation in public law consists of the following elements: presentational, logical, and pragmatic elements of argumentation. Another feature that marks judicial argumentation in public law is connected with the decreasing role of the audience during the court process. At the same time, this fact is not a reduction of the significance of argumentation. Additionally, judicial argumentation in public law can be reflected in the approach of communication techniques expressed in the verbal and written form. en_US
