вимоги ясності, доступності та зрозумілості тексту закону, вимоги легітимності законних очікувань, незворотності дії актів у часі та остаточності судових рішень.
The basis of the legal certainty principle is founded on the formal certainty of the essence of legal norms,
which is the result of logical, consistent, and full regulation of social relations, and providing a certain form
to these relations. The understanding of the legal certainty principle was formulated in the jurisprudence of
the European Court of Human Rights which regards legal certainty as one of the major elements of the rule
of law. The essence of the legal certainty is formulated within the legal quality demand, which consists of preciseness,
comprehensibility, understandability, and predictability of legal acts, which is achieved in the legislative
process with the help of legal drafting tools. Legislation may be predictable only when it is clear and
when legal norms are precisely and comprehensively formulated. Therefore, the legal certainty principle also
consists of the promulgation of legal acts. Legal certainty also requires the finality of court decisions, as well
as their execution. Besides, the legal certainty principle also relates to the principle of inability of the retroactive
act of law and the protection of legitimate expectations.
