Abstract
У статті подано огляд основних типів лінгвістичних експертиз, які використовують як юри-
дичний інструмент у судочинстві: 1) у справах, пов’язаних із документальними спорами; 2) у спра-
вах про захист честі, гідності та ділової репутації; 3) у справах про посягання на мир, національну
та громадську безпеку; 4) у справах про вимагання, погрози, шантаж; 5) у справах про введення
в оману; 6) у справах, пов’язаних із документальними записами власних назв; 7) у справах про
забезпечення охорони товарних знаків. По кожному з типів наведено коротку характеристику
об’єкта дослідження і тих завдань, які найчастіше висуває перед лінгвістичною експертизою прак-
тика правозастосування.
Description
Linguistic expertise is a kind of specialized linguistic study of the text materials or other linguistic objects
undertaken to clarify the issues having juridical consequences. The paper overviews the major types of forensic
linguistics research performed by the experts of the Ukrainian Bureau of Linguistic Expertise of the National
Academy of Sciences over the recent decade. These types are as follow: 1) expert examination of the disputed
juridical documents; 2) expert examination in the cases of protection of the person’s dignity and business
reputation; 3) expert examination of the appeals to illegal actions and violence, and expert examination in
the cases of stirring up interethnic hostility; 4) expert examination in the cases of threats and blackmail, and
expert examination of the dialogical texts (recordings of spontaneous speech, SMS messages, interrogation
reports, etc.); 5) expert examination in the cases of fraud; 6) expert examination of the documentary records
of personal names, place names, other proper names; 7) expert examination in the cases of protection of
the registered trademark. It is argued that a combination of semantic, structural, and linguo-pragmatic
approaches is a solid methodological foundation of competent expert investigations serving as evidence in
the legal proceedings.
The basic linguistic category underlying the methodology of the linguistic expert examination is the
concept of linguistic certainty which is a linguistic correlate of the juridical category of legal certainty that
presupposes that even if specific elements of a text or multiple interconnected texts do not provide for the
communicative preciseness and unambiguous understanding of the text or its elements, taking into account
broader legal discourse allows to achieve such communicative preciseness through the application of a
number of the formalized linguistic procedures.
