It reveals theoretical and practical issues of following this principle upon release from punishment. The author analyzes the status of the victim in criminal proceedings and critically assesses ignoring the interests of the victim by the legislator when the court addresses the issues that are resolved during the execution. Separate attention is paid to the court’s taking into account the fact of the guilty’s failing to compensate for damages caused by crime upon release from punishment. The study focuses on the doctrinal provisions and foreign legislation experience concerning the release from punishment based on the guilty’s not compensating the harm caused by the crime. The analysis includes legislative proposals for consideration by the court of the guilty’s not compensating for damages caused by the crime, in deciding on the exemption from punishment. Based on the research, the author puts forward proposals to the criminal and criminal procedural law in the context of consideration of the interests of the victim in deciding whether to release the guilty from punishment.У статті досліджено спеціальний принцип звільнення від покарання – врахування інтересів потерпілого.
