The author argues the priority of the human rights protection function of the bodies of constitutional jurisdiction, and analyzes the procedure of such protection as well as the issue of powers of the participants of the institute of individual constitutional claim. The article substantiates the necessity of introducing the constitutional claim in Ukraine and suggests ways of overcoming possible problems.У статті розкрито поняття та структурні елементи механізму захисту прав людини, шляхи забезпечення його дієвості, питання ефективності національних засобів захисту прав людини, зокрема, судового, пріоритетність правозахисної функції органів конституційної юрисдикції, процедури захисту прав людини конституційною юстицією, питання спроможності учасників інституту конституційної індивідуальної скарги.
