У статті здійснено аналіз правових засад відшкодування збитків за порушення цивільних зобов’язань. Акцентовано увагу на суперечностях та прогалинах, які допущено в ЦК України, інших законах при визначенні правових наслідків порушень цивільних зобов’язань. Запропоновано
рекомендації щодо вдосконалення механізму регулювання відшкодування збитків.
Description
The article analyzes legal grounds for damages claims and breaching civil obligations. The focus is made on the contradictions and gaps within the Civil Code of Ukraine and other laws concerning the determination of legal consequences of breaching civil obligations. Recommendations are provided
concerning the improvement of the regulation mechanism of damages claims.
The article determines and analyses the differences between civil and commercial legislation specifically concerning the essence and types of damages, as well as the correlation in the process of damages and forfeit claims. The Civil Code of Ukraine refers to surcharge damages claims, while the Commercial Code of Ukraine refers to creditable damages claims. Thus, the author concludes that civil legislation applies higher responsibility than that applied by the commercial legislation which does not seem logical, and is not just, while the Commercial Code of Ukraine is claimed to be the statute regulating mostly the issues among the commercial entities which should be subject to stricter responsibility for violations of contractual and other duties than that of the subjects to civil relations. The article points out inconsistencies in the drafting structure of the norms of the Civil Code of Ukraine determining the amount of damage claims. The absence of a systematic and logical approach in determination of the legal outcome of certain duties violation is also being within the focus of this research
