Abstract
Автореферат дисертації на здобуття наукового ступеня кандидата юридичних наук за спеціальністю 12.00.01 "Теорія та історія держави і права; історія політичних і правових учень" (081 – Право). – Національний університет "КиєвоМогилянська академія", Київ, 2019. У дисертації досліджуються права людства як особливі солідарні права третього покоління, які включають право на мир, на здорове довкілля та на сталий розвиток. Здійснено теоретичне узагальнення комплексного дослідження цих прав шляхом обґрунтування правосуб’єктності людства, дослідження відмінних ознак прав людства, а також опису кожного з обраних прав та аналізу наявних та потенційних механізмів захисту. Виділено відмінні ознаки прав людства та здійснено аналіз їх поступової юридизації. Концепція права людства є логічним продовженням розвитку прав першого та другого покоління, розвиваючи та доповнюючи їх. Наявні міжнародні інституції можуть фрагментарно забезпечувати захист прав людства, зокрема аналіз практики Європейського суду з прав людини дозволяє виокремити тренд динамічного тлумачення ним змісту деяких прав. Запропоновано також розглянути Міжнародний кримінальний суд як орган, що може притягати до відповідальності за найбільш тяжкі порушення прав людства. Крім того, інші механізми міжнародної співпраці, такі як моніторингові та миротворчі місії, а також проекти міжнародного розвитку розглянуто як можливі механізми захисту прав людства. При обговоренні вибору механізмів захисту прав людства запропоновано керуватися принципом застосування найбільш сприятливого режиму для їх захисту, що означає адаптування наявних механізмів міжнародної співпраці, захисту прав людини, а також виокремлення нових механізмів у разі необхідності.
Thesis abstract for a Candidate of Legal Sciences Degree in the specialization 12.00.01 Theory and History of State and Law; History of Political and Legal Thought. – National University of Kyiv-Mohyla Academy. – Kyiv, 2019. The thesis presents for the innovative concept of rights of humanity as special rights of the third generation human rights, including the right to peace, to healthy environment and to sustainable development. The research was based on theoretical synthesis and comprehensive study of these rights, defining therefore the structure, which included substantiation of the humanity’s legal subjectivity, establishment of distinguishing characteristics of rights of humanity, as well as a description of each of these rights, and the analysis of existing and potential mechanisms of their protection. The development of philosophical and legal approaches to the understanding of humanity as a separate subject of social relations has been studied in detail. The phenomenon of global co-dependency and the development of information and communication technologies define the universalistic angle of research. Particular attention is devoted to research of humanity’s legal subjectivity, which includes its ability to have rights and to exercise them, as well as to demand responsibility for their violation. The issue of responsible agents to protect these rights was raised. They might include international organizations, human rights defenders, etc. However, additional research is needed in this sphere. The distinguishing characteristics of the rights of humanity are the following ones: humanity is a subject of these rights; there is direct co-dependency between rights of humanity and human rights; protection of rights of humanity requires their implementation for all with respect to individual rights; extraterritoriality; belonging to different generations of humanity. Based on these distinguishing characteristics the following rights were selected: the right to peace, the right to healthy environment and the right to sustainable development. Each of these rights is discussed through their connection with human rights, their evolution in international law, the development and positive recognition in regional human rights conventions, as well as the rationale for the definition of humanity as a subject of these rights. While describing the right of humanity to peace its correlation with international humanitarian law was also discussed. The rights of humanity are a logical continuation of the development of the rights of the first and second generation of human rights. Each right of humanity is simultaneously a foundation for the existence of human rights and sui generis umbrella that protects them from violations. Active legal recognition (juridization) of the second generation human rights suggests that the possibility of protection of the rights of humanity will arise in future. The analysis of existing and potential mechanisms for the protection of human rights is also conducted. The rights of humanity are described from lex ferenda perspective. Therefore, the lack of clear mechanisms for their protection at the moment is understandable and leaves possibility for further research. The legal nature of rights of humanity requires mechanisms for their protection to be not limited to existing ones in realm of human rights doctrine, but to be considered in broader sense with other mechanisms of international cooperation that might be more relevant for these rights. Existing international institutions can provide some protection. In particular, the analysis of the case-law of the European Court of Human Rights suggests possibility to use its mechanism for protection based on the trend of a dynamic interpretation of certain rights. It is also proposed to consider the International Criminal Court as a body that can bring to liability those accused of committing the most serious violations of the rights of humanity. In addition, other mechanisms of international cooperation, such as monitoring and peacekeeping missions, as well as international development projects, are considered as possible mechanisms for their protection. The interdependence of rights of humanity and human rights is discussed and the possibility of their cross-protection has been argued in the thesis. Humanity faces the necessity of conscious change its approach to selfidentification in order to solve global problems, as well as to prevent their reoccurrence. Such challenges direct research into the study of the development of the concept of united humanity, development of concepts of global governance and democratic processes, not only at the national but also international level.
