Abstract
Дисертація на здобуття наукового ступеня кандидата юридичних наук за спеціальністю 12.00.01 "Теорія та історія держави і права; історія політичних і правових учень" (081 – Право). – Національний університет "Києво-Могилянська Академія", Київ, 2019. Дисертація є одним із перших у вітчизняній науці спеціальних комплексних досліджень, присвячених правовому режиму власності православної церкви за синодального періоду (1700-1917 рр.). Комплексність зумовлена трьома чинниками. Перший – здійснення юридичного аналізу фактичного матеріалу, який частково був об’єктом дослідження історичної науки, але такі дослідження характеризуються локальністю предмету, а також хронологічних та/або географічних рамок. Другий базується на синтезі доробку канонічної та світської наукової думки, використаної в контексті здійсненого дисертаційного дослідження. Третій чинник випливає із об’єкту дослідження, який узагальнено вбирає у себе всі види церковної власності, а також географічного ареалу – території Російської імперії. У роботі проаналізовано уживані щодо визначення церковної власності смислові конструкції та зроблено висновок про уніфікацію понятійного апарату на користь поняття, визначеного за допомогою прив’язки до суб’єкта права власності – церковна власність або церковне майно, які можуть використовуватися як синоніми. Також обґрунтовано існування церковної власності як окремого виду власності, проаналізовано теорії походження церковної власності, типологізовано об’єкти права церковної власності в контексті їхньої оборотоздатності й способів захисту. На підставі аналізу державно-церковних відносин від періоду зламу удільної системи та встановлення самодержавства у Московському князівстві зроблено висновок, що саме у цей період було закладено підвалини домінуючої ролі держави, і така модель в історичній науці отримала назву цезаропапізму. Державна домінанта підсилалась в результаті проведених Петром І реформ, наслідком яких було встановлення державного контролю над церковним майном, а також було проведено заміну патріаршого управління синодальним. Було створено державний орган – Святійший Синод, через який монархія здійснювала управління у сфері зовнішнього і внутрішнього життя церкви. Водночас при Св. Синоді було засновано посаду обер-прокурора, роль якої підсилилась у середині ХVІІІ ст. та залишалась суттєвою до кінця синодального періоду. Наслідком секуляризаційної реформи 1764 р. стало позбавлення архієрейських домів, церков і монастирів земельних володінь із одночасним введенням штатів (за класами), відповідно до яких провадилися регулярні виплати утримання від державної скарбниці. У ХVІІІ ст. результатом реформи став занепад чернецтва і монастирів, які відродилися у ХІХ ст. завдяки політиці надання індивідуальних дозволів на придбання землі, а також офірувань різними видами майна від монарших персон, юридичних і приватних осіб. Аналогічна реформа в українських землях була проведена на двадцять років пізніше, у 80-х рр. ХVІІІ ст. У роботі проаналізовано співвідношення термінів "канонічне право" і "церковне право". Церковне право розглядається як система норм походженням від верховної влади, з частковою імплементацією норм канонічного права. Церковним правом було врегульовано внутрішню структуру церкви, правовий статус окремих її інституцій, взаємовідносини з іншими церквами різних віросповідань, духовними центрами і державою, режим церковного майна, а також віднесені до відання православної єдиновірської церкви питання шлюбу, сім’ї, духовних заповітів, опіки й піклування. В результаті аналізу імперського законодавства і практики Цивільного касаційного департаменту Урядуючого Сенату було зроблено висновок про набуття окремими церковними інституціями статусу юридичних осіб – через визнання за ними майнової правоздатності, а також права бути позивачами і відповідачами в суді. На підставі аналізу ієрархічної структури православної церкви, ґрунтованої на канонічних правилах підпорядкування архієрейській владі, а також діючих за синодального періоду нормах законодавства, зроблено висновок про значну роль Св. Синоду, а також правлячих архієреїв і духовних консисторій у процесі реалізації окремими церковними інституціями повноважень власників. Така роль характеризувалась законодавчими ініціативами, заходами з уніфікації правозастосування, а також владно-розпорядчими та управлінськими функціями. Визначено способи набуття церковними інституціями права власності на об’єкти нерухомості – через дарування, пожертви, духовний заповіт, купівлюпродаж та внаслідок застосування правила земської давності. Набуття права власності на об’єкти нерухомості у Російській імперії було пов’язано із його визнанням державою (в законодавстві й у науковій літературі використовувався термін "укріплення права"). З’ясовано обсяг повноважень власників церковного майна щодо володіння і розпорядження ним, ступінь їхньої самостійності в процесі реалізації правомочностей власників, а також значний вплив на процес верховної влади, Св. Синоду та єпархіальних органів управління та контролю. Сформульоване на Соборі 1503 р. правило невідчужуваності церковних земель відтоді застосовувалось не у контексті неможливості експропріації церковної землі державою, але щодо неможливості церковним інституціям відчужувати належну їм землю самостійно. Для відчуження у всіх випадках потрібен був найвищий дозвіл. Церковні землі, будинки та оброчні (доходні) статті могли здаватися в оренду – при їхній низькій прибутковості й з дозволу єпархіального архієрея. Такого ж дозволу потребувало будівництво на церковній землі. Церковними домами визнавались приміщення храмів, каплички, будинки церковних училищ тощо. Їхнє будівництво було жорстко регламентовано – законодавством визначались не тільки будівельні умови і правила, але і заборона розташовувати поблизу церков шинки, харчевні й навіть храми інших конфесій. На підставі здійсненого аналізу зроблено висновок, що рухоме майно церкви, залежно від належності до речей сакральних або освячуваних, також підлягало жорсткій регламентації. Напрестольні речі були вилучені з цивільного обігу, за стародавніми канонічними правилами священні сосуди підлягали відчуженню тільки у випадках скрути, і то – у вигляді злитків, а не виробів. Ікони спадкувались без дорогоцінних риз, але ніколи – іновірцями. Убранство домових церков після смерті власника підлягало передачі найближчому храму, так же як речі старих або таких, що не підлягають ремонту церков. Окремий вид церковного майна становили грошові кошти. Захист церковної власності здійснювався судовим порядком на загальних підставах, оскільки власність церкви, на відміну від майна священно- і церковнослужителів, вважалась публічною. У 1902 р. сенатською практикою було змінено попереднє розуміння церковної землі як сакральної, а, відтак, невідчужуваної через не застосування до неї загального правила про давність. Захист церковної власності здійснювався також шляхом надання церкві преференцій у вигляді звільнення від стягнення окремих видів податків. На підставі аналізу державно-церковних відносин у Російській імперії зроблено науково обґрунтований висновок про недоцільність зрощування державних і церковних інституцій, а також державного контролю за внутрішнім і зовнішнім життям церкви як суспільного союзу. Роль держави на сучасному етапі має зводитися до встановлення правил створення, реєстрації та діяльності церковних структур, правовій регламентації церковного майна, а також, у разі потреби, наданні й обґрунтуванні преференцій щодо його оподаткування та захисту.
Thesis for a Candidate of Legal Sciences (Doctor of Philosophy) Degree, specialisation 12.00.01 "Theory and History of State and Law; History of Political and Legal Thought" (081 – Law).– National University of Kyiv-Mohyla Academy, Kyiv, 2017. The dissertation is one of the first in Ukraine of special comprehensive research, devoted to the legal regime of property of the Orthodox Church during the synodal period(1700-1917). The comprehensive character and complexity of this research is characterized by three factors. 1). The legal analysis of the actual material which was partly the subject of the study in historical science, but such studies are characterized by the local character of the subject, as well as the chronological and/or geographic framework. 2). Synthesis of the canonical and secular academic thought used in the context of the present research. 3).The object of the research encompasses all types of church property, as well as the geographical area – the territory of the Russian Empire. The present dissertation analyses the lexical constructions used in relation to the definition of the church property and concludes that the conceptual apparatus is unified in favour of the notion determined by means of an attachment to the subject of property rights – church property or church assets, which can be used as synonyms. It also substantiates the existence of church property as a separate type of property, analyses the theory of the origin of church property, typifies the objects of the law of church property in the context of their turnover potential and ways of protection. Based on the analysis of the state–church relations from the period of the breakup of theappanage system and the establishment of a unified state in Moscow Principality, it was concluded that it was during this period that the foundations of the dominant role of the state were laid, and this model in historical science was called cesarepapism. The dominant role of the state was increased as a result of Peter I reforms, which resulted in the establishment of the state control over the church property, as well as the replacement of the patriarchal administration by the synodal. A state body was created, the Holy Synod, through which the monarchy administered the church’s external and internal affairs. Simultaneously, at the Holy Synod, the office of Oberprocurator was established, the role and importance of which remained significant throughout the synodal period. As a consequence of the secularization reform of 1764, there was the deprivation of bishops’ houses and monasteries of land holdings with the simultaneous introduction of staff lists, according to which there were regular payments from the state treasury. In the 18th century the results of the reform lead to the decline of monasticism and monasteries, which revived in the nineteenth century due to the policy of granting individual permits for the purchase of land, as well as gifts from the monarchy individuals, legal and private persons. A similar reform in Ukrainian lands was carried out twenty years later in the 1780-ies. In the present research, the correlation between the terms "Canon law" and "Church law" is analysed.The Church law is considered as a system of norms originating from the supreme power, with the partial implementation of the rules of the Canon law. The Church law regulated the internal structure of the Church, the legal status of its individual institutions, relations with other churches of different faiths, spiritual centres and the state, the issues of church property, as well as specific issues attributed to the jurisdiction of the Orthodox monotheistic church: marriage, family, spiritual wills, guardianship and care. Based on the analysis of imperial legislation and practice of the Civil Cassation Department of the Governing Senate, it was concluded that the status of legal entities has been acquired by certain church institutions – by virtue of their recognition of property rights, as well as the right to beplaintiffsanddefendants in court. Based on the analysis of the hierarchical structure of the Orthodox Church, based on the canonical rules of submission to the bishopric authority, as well as the norms of law that were in force at that time, it was concluded that the Holy Synod, as well as the ruling bishops and spiritual consistories in the process of implementation of the powers of the owners by certain church institutions, was made. Such a role was characterized by legislative initiatives, measures to unify law enforcement, as well as power-administrative and managerial functions. The ways of acquiring church property rights to real estate objects were found out – through donations, offerings, spiritual testament, purchase and sale and as a result of the application of the rule of zemstvo prescription. The acquisition of ownership of real estate in the Russian Empire was due to its recognition by the state – there was the so-called serfdom system of registration of property rights, which resulted in the process of obtaining and registering the right received in the legislation and in the academic literature the general name of "strengthening of the right". The volume of powers of the owners of the church property in relation to possession and disposal of them, the degree of their independence in the process of exercising the powers of the owners, as well as the significant influence on it by the supreme authority, the Holy Synod and the diocesan authorities and control. Formulated at the Council in 1503, the rule of inalienability of church lands was now used not in the context of the impossibility of expropriating church land by the state, but in relation to the inability of church institutions themselves to alienate their land. Church lands were subject to alienation in all cases with a monarchical permission, or due to the need for their use in new construction or road building. Church lands, houses and obrok (servage tax) articles could be leased – with their low profitability and with the permission of the diocesan bishop. The same permission required the construction on church land. As church buildings were recognized the rooms of temples, chapels, houses of church schools, etc. Their construction was rigorously regulated – the legislation was determined not only by building constraints and rules, but also by the prohibition of placement near churchesof pubs, taverns and even temples of other denominations. On the basis of the carried out analysis, it was concluded that the movable property of the church, depending on its affiliation with the things of the sacred or sanctified, was also subject to strict regulation. Crucifixions were removed from civilian circulation, according to ancient canonical rules, sacred vessels were subject to alienation only in cases of grievances, and only in the form of ingots, and not products. The icons were inherited without precious jewels, but never – by gentiles. The decoration of the house churches after the death of the owner was to be transferred to the nearest temple, as well as things of the old churches or those that are not subject to the repair. A separate type of church property was made up of cash – the means of wards, as well as circle and board fees for missionary needs. Protection of church property was carried out by the court order on general grounds, since the property of the church, in contrast to parochial lands and the property of the sacred and clergy, was considered public. In 1902, Senate practice has changed the prior understanding of the church land as a sacred, and, therefore, inalienable because of the non-application of the general rule on limitation. Protection of church property was also carried out by granting the church preferences in the form of exemption from taxation, for example, a municipal ("city") collection. On the basis of the analysis of state–church relations in the Russian Empire, a scientifically grounded conclusion was made about the inexpediency of merging state and church institutions, as well as state control over the internal and external life of the church as a social union. The role of the state at the present stage should be reduced to the establishment of rules for the creation, registration and activities of church structures, legal regulation of church property, as well as, if necessary, the provision and justification of preferences for its taxation and protection.
