Аносова Ю.В. Юрисдикція міжнародних судових органів щодо злочину геноциду. - Кваліфікаційна наукова праця на правах рукопису. Дисертація на здобуття наукового ступеня кандидата юридичних наук (доктора філософії) за спеціальністю 12.00.11 "Міжнародне право" (293 – Міжнародне право). – Національний університет "Києво-Могилянська академія", Київ, 2018. Узагальнений короткий виклад основного змісту дисертації. У дисертації досліджується юрисдикція міжнародних кримінальних судів та Міжнародного Суду ООН (МС) щодо злочину геноциду з позицій інтегративного підходу до відповідальності осіб та держав згідно з міжнародним правом. У Розділі 1 "Загальна характеристика злочину геноциду в світлі юрисдикції міжнародних судових органів" розглядаються концептуальні підходи до розуміння юрисдикції міжнародних судових органів. Аналізується змістовне наповнення та доводиться комплексність природи Конвенції запобігання злочину геноциду та покарання за нього (Конвенція про геноцид). Дисертант доходить висновку, що даний документ потрібно одночасно розглядати як класичний міжнародно-правовий договір, кримінально-правовий інструмент та міжнародний договір з прав людини. Здійснюється огляд судової практики міжнародних судових органів, якою підтверджується, що заборона геноциду передбачена не лише в Конвенції про геноцид, але також і в інших джерелах міжнародного права. Досліджуються особливості тлумачення міжнародними кримінальними судами складу злочину геноциду та окремих його елементів, зокрема, actus reus, mens rea та контекстуального елемента. Розділ 2 "Юрисдикція міжнародних кримінальних судів щодо злочину геноциду" присвячено аналізу засад та окремих аспектів здійснення юрисдикції щодо злочину геноциду міжнародними кримінальними судами. Проведено історичний огляд процесу обговорення та обґрунтування доцільності включення статті 6 до Конвенції про геноцид. Після детального аналізу змісту цієї статті та її співставлення з процедурою утворення сучасних міжнародних кримінальних судів, робиться висновок, що Міжнародний кримінальний суд (МКС) є найбільш наближеною моделлю суду, що підпадає під визначення статті 6 Конвенції про геноцид. Незважаючи на те, що інституційно МКС не залежить від положень Конвенції про геноцид, положення статті 6 може допомогти "підсилити" юрисдикцію МКС, принаймні щодо злочину геноциду. Автор наводить дві практичні проблеми, з якими зіштовхується МКС у своїй діяльності і які можуть бути вирішені через застосування Конвенції. Зокрема, це питання поширення юрисдикції МКС на громадян держав, що не є сторонами Римського Статуту Міжнародного кримінального суду (Римського статуту), а також зловживання персональними імунітетами високопосадовцями, які обвинувачуються у вчиненні геноциду. Дисертант детально аналізує персональну, територіальну та темпоральну юрисдикцію Міжнародного кримінального трибуналу щодо колишньої Югославії, Міжнародного кримінального трибуналу щодо Руанди та МКС. Обґрунтовується необхідність розгляду форм відповідальності як складової юрисдикції ratione personae міжнародних кримінальних судів. Досліджуються традиційні та нові форми відповідальності за злочин геноциду. Особлива увага приділена характеристиці застосування форм відповідальності щодо злочинів зі спеціальним наміром, а також співставленню форм відповідальності, передбачених в Конвенції про геноцид та статутах міжнародних кримінальних судів. При дослідженні питань юрисдикції ratione loci міжнародних кримінальних судів констатується відносно чітка визначеність такої юрисдикції в статутах ad hoc Трибуналів та теоретична необмеженість територіальної юрисдикції МКС у випадку застосування активного персонального принципу чи передачі ситуації РБ ООН. В контексті дослідження юрисдикції ratione temporis, автор вказує, що для МКС така юрисдикція є проспективною та залежить від дати набрання чинності Римським Статутом для держави-сторони, а для ad hoc Трибуналів – ретроактивною та обмежується часовими межами, визначеними в їх статутах. У Розділі 3 "Юрисдикція Міжнародного Суду ООН щодо геноциду" констатується, що завдяки існуванню Конвенції про геноцид Міжнародний Суд ООН є ефективним механізмом забезпечення відповідальності держав за геноцид. Підставою здійснення МС юрисдикції щодо злочину геноциду згідно з Конвенцією є "компромісна умова" статті 9. Встановлено, що юрисдикція МС ratione personae поширюється на держави, які, по-перше, отримали доступ до Суду згідно зі статтею 35 Статуту МС, а по-друге, прийняли юрисдикцію Суду, ставши стороною Конвенції про геноцид, якщо при цьому вони не вносили застереження до статті 9 Конвенції, яке виключає юрисдикцію МС. Дисертант аналізує справи МС щодо геноциду і детально розглядає практичні проблеми при встановленні юрисдикції ratione personae МС. Зокрема, це питання, пов’язані з визначенням статусу держави в межах ООН в контексті доступу до Суду, а також правонаступництва щодо міжнародних договорів, включаючи Конвенцію про геноцид, в контексті юрисдикції Суду. Автором здійснюється детальний аналіз юрисдикції МС ratione materiae. Констатується, що даний аспект юрисдикції Суду базується на "титулі юрисдикції", що є поєднанням двох складових: статті 36(1) Статуту МС та "компромісній умові" Конвенції про геноцид. Останнім положенням визначаються категорії спорів, що належать до предметної юрисдикції МС. Дисертантом детально проаналізовано кожну з цих категорій та визначено особливості їх співвідношення. Особливу увагу приділено категорії спорів щодо відповідальності держав за геноцид, і зокрема, методиці, розробленій МС для оцінки такої відповідальності. В контексті дослідження юрисдикції МС щодо геноциду ratione temporis проаналізовано питання щодо можливості ретроактивного застосування Конвенції про геноцид, а також ретроактивної дії міжнародного звичаєвого права щодо геноциду. Автор доходить висновку, що Конвенція про геноцид як позитивне право не застосовується ретроактивно, а отже МС матиме юрисдикцію лише щодо діянь, які мали місце після набуття чинності Конвенцією щодо держави-позивача та держави-відповідача. При цьому не виключається застосування міжнародного звичаєвого права до подій, що передували прийняттю Конвенції, якщо МС здійснює обов'язкову юрисдикцію. Також висвітлюється такий важливий для встановлення юрисдикції МС аспект, як розмежування фактів, на яких базується спір, та подій, що призвели до цих фактів. В контексті розгляду юрисдикції МС ratione loci визначено територіальну дію окремо для кожного з обов’язків держав, передбачених Конвенцією про геноцид. В підсумку автор узагальнює особливості взаємодії режимів міжнародно-правової відповідальності держав та міжнародної кримінальної відповідальності індивідів за геноцид та відмічає тенденцію їх зближення в сучасному міжнародному праві. Наукова новизна дисертації. Дана дисертаційна робота являє собою комплексне дослідження юрисдикції міжнародних судових органів щодо злочину геноциду з позицій інтегративного підходу до відповідальності згідно з міжнародним правом. Вперше: - проаналізовано проблеми реалізації юрисдикції міжнародних судових органів, які можна було б вирішити, спираючись на юрисдикційні положення Конвенції про геноцид; - запропоновано розглядати форми відповідальності як складову юрисдикції ratione personae міжнародних кримінальних судів та детально розглянуто ті форми відповідальності, що застосовуються виключно щодо злочину геноциду, а також їх співвідношення з формами відповідальності, що застосовуються до інших злочинів. Вперше у вітчизняній науці здійснено огляд нових, комплексних форм відповідальності, зокрема, "спільної злочинної діяльності" (СЗД) та "співвиконання, що ґрунтується на спільному контролі над злочином"; - здійснено комплексний аналіз юрисдикції МС за параметрами ratione personae, ratione materiae, ratione temporis та ratione loci щодо геноциду з врахуванням судової практики останніх років. Окрему увагу приділено впливу питань правонаступництва держав на особливості здійснення юрисдикції МС. Удосконалено: - застосування інтегративного підходу до дослідження відповідальності держав та індивідів за геноцид згідно з міжнародним правом, зокрема в контексті аналізу юрисдикції міжнародних судових органів, що діють в межах цих режимів; - розуміння концепції злочину геноциду, його складу та окремих елементів, зокрема actus reus, mens rea та контекстуального елементу з урахуванням судової практики останніх років; - обґрунтування причин включення юрисдикційних положень до Конвенції про геноцид, а також висвітлення еволюції в тлумаченні цих положень в теорії та практиці сучасного міжнародного права. Отримали подальший розвиток: - розуміння особливостей ретроактивного застосування положень міжнародних договорів для характеристики подій, що мали місце до набрання ними чинності, в контексті темпоральної юрисдикції судових органів, уповноважених застосовувати відповідні договори, на прикладі ЄСПЛ та МС; - концептуальний підхід, що відображає зближення режимів міжнародної кримінальної відповідальності індивідів та міжнародно-правової відповідальності держав за геноцид; - характеристика інституту правонаступництва держав щодо міжнародних договорів в контексті здійснення МС юрисдикції ratione personae. Практичне значення дисертації. Одержані в ході дисертаційного дослідження результати можуть бути використані: - в навчальному процесі, зокрема, через включення до відповідних розділів підручників, навчальних посібників, методичних матеріалів тощо, а також при розробці та викладанні таких навчальних курсів, як "Міжнародне публічне право", "Міжнародне кримінальне право" та "Міжнародне право захисту прав людини" у вищих юридичних навчальних закладах; - для сприяння більш професійному оперуванню міжнародно-правовою термінологією дослідниками в різних галузях знань при характеристиці відповідних подій, зокрема в межах історичної, політичної, соціологічної та юридичної наук; - при визначенні політики України в питанні щодо необхідності та наслідків ратифікації Римського Статуту МКС згідно зі статтею 124 Конституції України, приведенні українського кримінального законодавства у відповідність з положеннями Римського Статуту, а також при виробленні стратегії представлення злочинів та відбору доказів, що подаються Україною до МКС; - при оцінці необхідності створення, і у випадку прийняття позитивного рішення, – визначення юрисдикції ad hoc Трибуналу, що зможе розглядати справи щодо злочинів, вчинених на території АРК, Донецької та Луганської областей; - в правозастосовній діяльності – для керівництва вітчизняних органів досудового розслідування і прокуратури, а також суддів в досудовому розслідуванні та судовому провадженні в справах щодо злочинів, передбачених розділом ХХ Кримінального кодексу України, зокрема, при розгляді питань щодо складу міжнародних злочинів, а також особливостей застосування форм відповідальності до міжнародних злочинів; - в правотворчій сфері, зокрема, при нормопроектуванні та внесенні змін до Кримінального кодексу України, що узгоджуються з сучасними вимогами міжнародного кримінального права.
Anosova Y. V. The Jurisdiction of the International Judicial Bodies over the Crime of Genocide. – Qualification research work, presented as manuscript. Dissertation for obtaining the degree of Candidate of Legal Sciences (Doctor of Philosophy) with specialization in 12.00.11 "International Law" (293 – International Law). – National University of "Kyiv-Mohyla Academy", Kyiv, 2018. Summary of the dissertation. Dissertation explores the jurisdiction of the international criminal courts (including ICC, ICTY, ICTR) and the International Court of Justice (the ICJ) over the crime of genocide from the point of integrative approach to responsibility of individuals and states under international law. In the Chapter 1 "The general characteristic of the cime of genocide in the light of the jurisdiction of the international judicial bodies" the conceptual approaches to the jurisdiction of the international judicial bodies are examined. The content of the Convention on the Prevention and Punishment of the Crime of Genocide (the Genocide Convention) is analyzed and the complexity of its legal nature is proven. The author concludes that this document should be regarded as a classical international treaty, international criminal law instrument and international human rights treaty. On the basis of the case law of international judicial bodies it is highlighted that, in addition to the Genocide Convention, the prohibition of genocide is confirmed in other sources of international law. Particular issues concerning the interpretation by the international criminal courts of the elements of the crime of genocide, including actus reus, mens rea and contextual element, are explored. In the Chapter 2 "The jurisdiction of the international criminal courts over the crime of genocide" the author analyzes the substance and separate aspects of the exercise of jurisdiction by the international criminal courts over the crime of genocide. Historic overview of the process of negotiation and the motives behind inclusion of the Article 6 to the Genocide Convention are presented. On the basis of the detailed analysis of the content of this article and matching its application with the procedure of establishment of contemporary international criminal courts, it is concluded that the International Criminal Court (the ICC) is the most corresponding model of the court, as defined under the Article 6 of the Genocide Convention. Furthermore, even though institutionally the ICC is independent from the provisions of the Genocide Convention, the provision of the Article 6 might help to "reinforce" the jurisdiction of the ICC, at least when the crime of genocide is concerned. The author outlines two practical problems faced by the ICC, which could be solved through the application of the Convention. The first problem concerns the spread of the ICC`s jurisdiction over the nationals of the States, which are not parties to the Rome Statute of the International Criminal Court (the Rome statute). The second one is the misuse of personal immunities by high officials, accused of the commission of genocide. The author explores in detail the personal, territorial and temporal jurisdiction of the International Criminal Tribunal for the Former Yugoslavia, International Criminal Tribunal for Rwanda and the ICC. It is claimed that the forms of liability should be viewed as a part of jurisdiction ratione personae of international criminal courts. Thus, traditional and new forms of liability are examined. Special coverage is given to the description of the application of the forms of liability in relation to crimes with a special intent as well as the comparison of forms of liability provided in the Genocide Convention and the statutes of the international criminal courts. As a result of the analysis of the jurisdiction ratione loci of the international criminal courts, the author observes relatively clear definition of this aspect of jurisdiction in the statutes of the ad hoc Tribunals and theoretically unlimited territorial jurisdiction of the ICC in case of the application of the active personality principle or the UN Security Council referral of a situation. In the context of the jurisdiction ratione temporis the author points out that the ICC possesses the prospective jurisdiction, which starts from the moment of entry into force of the Rome Statute for the State party, while ad hoc Tribunals` jurisdiction is retroactive and is limited by the timeframe determined by their statutes. In the Chapter 3 "The jurisdiction of the International Court of Justice over genocide" it is claimed that due to the application of "compromissory clause" of Article 9 of the Genocide Convention, the ICJ is the effective mechanism of the realization of state responsibility for genocide. Jurisdiction ratione personae of the ICJ extends upon states, which received the access to the Court according to Article 35 of the ICJ Statute as well as accepted the jurisdiction of the Court while becoming party to the Genocide Convention, on the condition that they did not make a reservation to the Article 9 excluding Court`s jurisdiction. The author analyzes the case law of the ICJ on genocide and discerns the practical problems with the establishment of the Court`s jurisdiction ratione personae. These include the issues of determination of the status of a state within the UN, in the context of access to the Court, and the succession to international treaties, and in particular the Genocide Convention, in the context of the jurisdiction of the Court. The author explores in detail the ICJ`s jurisdiction ratione materiae. It is stated that this aspect of the Court`s jurisdiction is based on "title of jurisdiction", which comprises of two components: Article 36(1) of the ICJ Statute and "compromissory clause" of the Genocide Convention. The last provision defines the categories of disputes under the subject matter jurisdiction of the ICJ. The author analyzes every category and brings to light the relationship between each of them. Special attention is paid to the category of the responsibility of states for genocide, and in particular the methodology used by the ICJ for the establishment of such responsibility. In the context of the ICJ`s jurisdiction ratione temporis, the issue of the possibility of the retroactive application of the Genocide Convention and customary international law on genocide is analyzed. The author concludes that the Genocide Convention as positive law is not applied retroactively and therefore the ICJ may have jurisdiction only in relation to the acts taking place after the entry into force of the Genocide Convention for the applicant and respondent states. As for the customary international law, its effect as to the events preceding the adoption of the Genocide Convention cannot be excluded, however, only if the ICJ exercises compulsory jurisdiction. In addition, such an important aspect of the Court`s temporal jurisdiction as the delineation between the facts, which constitute the basis of the dispute, and the events, which brought about the respective facts, is highlighted. In the context of the ICJ`s jurisdiction ratione loci, the territorial effect of every of the state obligations under the Genocide Convention is defined. In the end, the author summarizes the specific features of the interaction between the regimes of state and individual responsibility for genocide and points out to the tendency of their approximation under contemporary international law. Academic novelty. The dissertation is a comprehensive study of the jurisdiction of the international courts and tribunals over the crime of genocide from the perspective of the integrative approach towards the concept of responsibility under international law. For the first time: - the problems of the exercise of jurisdiction by the international courts are analyzed as well as solutions to these problems based on the jurisdictional provisions of the Genocide Convention; - it is offered to view the forms of liability as part of the jurisdiction ratione personae of the international criminal courts. The forms of liability which apply to the crime of genocide are explored as well as their interaction with the forms of liability applicable to other crimes. For the first time in Ukrainian legal science the new, complex forms of liability are examined, and in particular, "joint criminal enterprise" (JCE) and "co-perpetration based on joint control over the crime"; - the ratione personae, ratione materiae, ratione temporis and ratione loci jurisdiction of the ICJ over genocide is analyzed, based on the most recent case law. Special attention is given to the issue of the ICJ jurisdiction in the context of the succession of states. Improved: - the application of integrative approach to the research of the regimes of responsibility of states and individuals under international law, and in particular, in the context of the jurisdiction of international courts functioning within these regimes; - the understanding of the concept of the crime of genocide and its elements, including actus reus, mens rea and the contextual element, based on the most recent case law; - the explanation of the reasons underlying the inclusion of the jurisdictional provisions to the Genocide Convention as well as highlighting of the evolution in the interpretation of respective provisions in theory and practice of contemporary international law. Further developed: - the understanding of the retroactive application of the international treaties for the qualification of events taking place before their entrance into force in the context of the temporal jurisdiction of the courts authorized to apply the respective treaties, as exemplified by the ECHR and ICJ; - the conceptual approach reflecting the approximation of the regimes of the individual criminal responsibility and state responsibility for genocide; - the analysis of the institute of the succession of states to international treaties in the context of the ICJ`s exercise of the jurisdiction ratione personae. Practical significance. The scientific results of the dissertation can be used: - in educational process, through the inclusion to the respective sections of the textbooks, training aids, study guides etc., as well as for the teaching in law schools of such courses as Public International Law, International Criminal Law, International Human Rights Law; - as the assistance to the researchers from different disciplines in more accurate use of the international legal terminology for the qualification of certain events, especially within historical, political, sociological and legal sciences; - for the determination of the policy and attitude of Ukraine to the necessity and consequences of the ratification of the Rome Statute of the ICC according to the Art. 124 of the Constitution of Ukraine; for bringing of Ukrainian criminal legislation into line with the provisions of the Rome Statute; for the determination of the better strategy of the presentation of the crimes and selection of evidence being submitted by Ukraine to the ICC; - for the determination of necessity of the establishment, and in the case of a positive decision, - determination of the jurisdiction - of the ad hoc Tribunal, authorized to hear the cases about the crimes committed in the occupied Crimea, Donetsk and Luhansk regions; - in the sphere of law enforcement – as guidance for the national bodies of pre-trial investigation, public prosecution and courts in the course of criminal persecution under Section XX of the Criminal Code of Ukraine, and in particular, in the issues concerning elements of the international crimes and the application of the forms of liability for international crimes; - in the law-making – in the process of drafting and adopting amendments to the Criminal Code of Ukraine which would correspond to the existing standards of the international criminal law.
