Деякі питання визнання права власності за статтею 392 Цивільного кодексу України

Abstract

У статті досліджено підстави визнання права власності, передбачені ст. 392 ЦК України. Визначено особливості визнання права власності на об’єкти самочинного будівництва, майно, на яке звертається стягнення. Виявлено прогалини і суперечності у законодавстві України, неоднакове застосування судами законодавства у сфері визнання права власності та запропоновано шляхи для їх подолання.

The article analyzes the grounds of recognition of a property right under section 392 of the Civil Code of Ukraine. It establishes the specifics of recognizing the right of property as to an object of unauthorized construction, and foreclosed property. The article discloses gaps and contradictions in the legislation and court cases while pointing out different approaches of the application of law governing recognition of the property right and offers solutions as to its improvement.
