розгляду та реалізацію застосування «духу» права саме через дискреційні повноваження.
This article deals with the analysis of the discretion of the court, the limits of discretion, and the analysis
of implementation of the «spirit» of law as the discretion powers.
It addresses the definition of the “spirit” of law. The term of the «spirit» of law is so comprehensive that it
is impossible to give a clear definition.
Discretion powers of the courts are in essence using the «spirit» of law because it gives a person the procedure
how to protect their rights and freedoms.
In addition, it helps to protect against bureaucracy in trial and helps to implement the principle of rapid
and fair justice. The «spirit» of law in its own way is the limits of discretion powers of the court.
The «spirit» of law as limits of discretion of the court must not be used in manipulation and substitution of
concepts. To protect from such manipulation, one should apply not the “spirit” of law by itself but the principles
and elements of the «spirit» of law. For example, to limit the discretionary power of the court one should
use such principles as the rule of law, justice, equality, fairness, fundamental rights and freedoms, which are
mainly fixed in the European Convention on Human Rights.
