Верховенство права, права людини і місцеве самоврядування: проблеми взаємозв'язків

Abstract

У статті простежено еволюцію у розумінні верховенства права у вітчизняному правознавстві та юридичній практиці, розкрито взаємозв’язки між верховенством права, правами людини і місцевим самоврядуванням, а також окреслено коло проблем, пов’язаних із захистом прав людини, що поста- ють перед органами державної влади і місцевого самоврядування у нинішніх українських умовах.

The article addresses the evolution of the rule of law understanding within the national legal scholarship and legal practice. The article expands on the interconnecting issues between the rule of law, human rights, and local self-government with a focus on the issues arising before state and municipal bodies regarding the human centered refocusing of the ruling and managerial ideology, the genesis of the public services institute, etc. A special focus is made on the legal issues developed as a result of Russian aggression against Ukraine, specifically on the protection of internally displaced persons and Ukrainian citizens having stayed to live on the territories of Donbas and the Crimea temporarily out of Ukrainian control.
