Заохочувальні адміністративні процедури: деякі проблемні питання реалізації

Abstract

У статті досліджено особливості реалізації заохочувальних адміністративних процедур, у яких предметом заохочення є вогнепальна зброя. Проаналізовано систему нормативно-правових актів, які регламентують такий вид процедур, систему суб’єктів, які застосовують таке заохочення. Акцентовано увагу на спірних та неоднозначних аспектах реалізації заохочувальних адміністративних процедур.

The article researches the features of implementation of incentive administrative procedures which have firearms as an incentive. The analysis is focused on the system of regulations governing this type of procedure, the system of subjects which use this award. Firearms as an incentive are used as a state award. This is provided by the Law of Ukraine “On State Awards of Ukraine”. At the same time, the Disciplinary Regulations of the Armed Forces of Ukraine allow the use of firearms as a departmental award. The procedure of awarding by firearms as a state award establishes the range of persons who may be awarded, the procedure of the awarding and a detailed description of the weapon. The procedure of awarding with firearms as departmental award is applied by the Ministry of Defence of Ukraine, Ministry of Internal Affairs of Ukraine, the State Guard of Ukraine, the Security Service of Ukraine, the Foreign Intelligence Service of Ukraine, and the State Special Communications Service of Ukraine. The procedure of awarding by these bodies does not consider a unique class of persons who may be awarded, neither it contains descriptions of the departmental awards. The attention is focused on controversial and ambiguous aspects of incentive administrative procedures. It is inappropriate to have firearms as an incentive as the state award and departmental incentive awards simultaneously. The conclusion about the possibility of abuse in the application of incentive administrative procedures which have firearms as an incentive has been made.
